1. Acceptance of These Terms
Welcome to the website of The Tarik S. Pierce Foundation ("TSPF," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of www.tspfoundation.org and any related pages, content, and services (together, the "Site"). By accessing or using the Site, subscribing to our updates, opting in to text messages, or making a donation, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
2. About Us
The Tarik S. Pierce Foundation is a nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code, based in Washington, D.C. Our mission is to foster togetherness, belonging, and support for the LGBTQ+ community through small acts that have a big impact.
3. Use of the Site
You may use the Site for lawful, personal, and non-commercial purposes. You agree not to:
Use the Site in any way that violates any applicable law or regulation.
Interfere with or disrupt the operation of the Site or the servers or networks that host it.
Attempt to gain unauthorized access to any portion of the Site, other accounts, or any systems or networks connected to the Site.
Use the Site to transmit any harmful, harassing, defamatory, or otherwise objectionable content.
Use any robot, scraper, or other automated means to access the Site or collect information from it without our permission.
We may suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to us or others.
4. Donations
The Tarik S. Pierce Foundation is a tax-exempt charitable organization under Section 501(c)(3) of the Internal Revenue Code. Contributions to TSPF may be tax-deductible to the extent permitted by law. No goods or services are provided in exchange for a donation unless otherwise stated. Please consult your tax advisor regarding the deductibility of your gift.
Donations are processed by a third-party payment service, and your use of that service is subject to its own terms and privacy policy. You represent that any payment information you provide is accurate and that you are authorized to use the payment method. If you believe an error was made in processing your donation, please contact us at impact@tspfoundation.org and we will work with you to resolve it.
5. Email and Text (SMS) Messaging
By subscribing to our email list or opting in to receive text messages, you consent to receive communications from The Tarik S. Pierce Foundation, which may include newsletters, program and event updates, volunteer requests, and donation requests. The following terms apply to our text-messaging program:
By opting in to receive text messages from The Tarik S. Pierce Foundation, you consent to receive informational and fundraising messages from us.
You can cancel the SMS service at any time by replying "STOP" to any message from us. After you send "STOP," we will send you a message to confirm that you have been unsubscribed, and you will no longer receive SMS messages from us. If you want to rejoin, sign up again as you did the first time.
If you are experiencing issues with the messaging program, reply with the keyword "HELP" for assistance, or contact us directly at impact@tspfoundation.org.
Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have questions about your text or data plan, please contact your wireless provider.

6. Intellectual Property
The Site and its content, including text, graphics, logos, images, and the name and marks of The Tarik S. Pierce Foundation, are owned by or licensed to us and are protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works from the Site or its content without our prior written permission, except that you may view and share content for personal, non-commercial purposes with appropriate attribution.
7. Third-Party Links and Services
The Site may contain links to third-party websites and services, including our donation processor, email and text-messaging platforms, and event-management tools. These third parties are not controlled by us, and we are not responsible for their content, products, services, or practices. The inclusion of a link does not imply our endorsement.

To the fullest extent permitted by law, The Tarik S. Pierce Foundation and its directors, officers, volunteers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Site.

You agree to indemnify and hold harmless The Tarik S. Pierce Foundation and its directors, officers, volunteers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

We may modify these Terms from time to time. Any changes will become effective when we post the revised Terms on the Site. Your continued use of the Site after we post changes means you accept the revised Terms.
12. Governing Law
These Terms are governed by the laws of the District of Columbia and applicable federal law, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in the District of Columbia.
