This website, www.tspfoundation.org (the "Site"), is operated by The Tarik S. Pierce Foundation ("TSPF," "we," "us," or "our"), a nonprofit organization recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code and based in Washington, D.C.
We are committed to protecting your privacy. By providing Personal Information to us, you agree to the terms of this Privacy Policy.
2. Updates to This Privacy Policy
Please review this Privacy Policy periodically, because we modify it from time to time. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Site. Each time you visit the Site or provide us with information through the Site, you are accepting the practices described in the Privacy Policy in effect at that time.

"Personal Information" is information that identifies you as an individual, such as:

We collect information you give us when you subscribe to our updates, register for or attend an event, sign up to volunteer, contact us, or make an online donation. For example, when you make a donation, in addition to your name and contact information, you will need to provide a billing address and payment information so that your gift can be processed and acknowledged.

We may use Personal Information:
To respond to your inquiries and fulfill your requests, such as to send you updates, newsletters, or event information by email. For information about how to unsubscribe, please see the "Choices and Access" section below.
To communicate with you about our programs, events, and volunteer opportunities.
To process and acknowledge your donation or payment, and to send you a receipt.
To send you important administrative information, such as changes to our terms, conditions, and policies.
To comply with applicable law, including any tax, reporting, or recordkeeping obligations that apply to a charitable organization.
For our own purposes, such as data analysis, improving our programs and our website, identifying usage trends, and measuring the effectiveness of our work.
As we believe to be necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public and government authorities; (d) to enforce our terms and conditions; (e) to protect our operations; (f) to protect our rights, privacy, safety, or property, or that of you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.
Our commitment to you: We do not sell, rent, trade, or otherwise share your personal or donor information with any third party for their own marketing or fundraising purposes. Your trust is central to our mission of building belonging in our community.
5. How Personal Information Is Disclosed
Your Personal Information may be disclosed:
To third parties when you voluntarily provide such information, or when you use certain features available on the Site (for example, submitting a public comment or sign-up). We urge you to be careful when deciding to disclose your Personal Information on the Site.
To our third-party service providers who perform services on our behalf, such as website hosting, data analysis, donation and payment processing, email and text-message delivery, constituent relationship management, and event management. These providers are permitted to use your information only to provide services to us, and not for their own purposes.

b. How we collect Other Information
We and our third-party service providers may collect Other Information in a variety of ways, including:
Through your browser: Certain information is collected by most browsers, such as your Media Access Control (MAC) address, computer type, screen resolution, operating system version, and internet browser type and version.
Through server log files: An Internet Protocol (IP) address is a number automatically assigned to the computer you are using by your Internet Service Provider (ISP), and is logged automatically in our server log files whenever a user visits the Site, along with the time of the visit and the pages visited. We use IP addresses for purposes such as calculating Site usage levels, helping diagnose server problems, and administering the Site.
Using cookies: Cookies allow a web server to transfer data to a computer for recordkeeping and other purposes. We and our service providers use cookies and other technologies to better serve you with tailored information, facilitate your ongoing access to and use of the Site, and for analytics purposes. Using pixel tags and similar technologies: We may use pixel tags (also known as web beacons and clear GIFs) in connection with some Site pages and email messages to track the actions of Site users and email recipients, measure the success of our outreach, and compile statistics about Site usage and response rates.
From you: We may collect demographic information such as your location, as well as your preferred means of communication, when you voluntarily provide it. Unless combined with Personal Information, this information does not personally identify you.
By aggregating information: We may aggregate information so that the end product does not personally identify you or any other user of the Site.
c. How we use and disclose Other Information
Because Other Information does not personally identify you, we may use and disclose it for any purpose. If we combine Other Information with Personal Information, the combined information will be treated as Personal Information for as long as it is combined.
7. Security
We use reasonable organizational, technical, and administrative measures to protect Personal Information under our control. Unfortunately, no data transmission over the internet can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us as described in the "Contacting Us" section below.
8. Online Privacy Protection
We comply with the California Online Privacy Protection Act. As part of that Act, all users of our Site may make changes to their information at any time by contacting us as described below. Changes to billing or credit card information must be made through our staff or through our payment processor. Please contact us with any questions.
9. Choices and Access
a. Your choices regarding our use and disclosure of your Personal Information
We give you choices regarding our use and disclosure of your Personal Information. You may opt out from receiving newsletters, updates, or other non-administrative emails from us at any time by emailing impact@tspfoundation.org or by using the unsubscribe link in any such email. We will comply with your request as soon as reasonably practicable. Even if you opt out of these messages, we may still send you important administrative messages, from which you cannot opt out.
b. How you may access or change your Personal Information
If you would like to review or update Personal Information you have previously provided to us, please contact us at impact@tspfoundation.org. In your request, please make clear what information you would like changed. We will comply as soon as reasonably practicable.
10. Mobile Messaging Policy
a. Opt-in. We allow supporters to receive mobile (text) messages by affirmatively opting in. By opting in, you consent to receive text messages from The Tarik S. Pierce Foundation, which may include updates, event invitations, volunteer requests, and donation requests, at the phone number associated with your opt-in. Some of our messages may be sent using an automatic telephone dialing system. Message and data rates may apply. Message frequency varies. We will not sell or share your text-messaging opt-in data, consent, or related personal information with any third party, except as required by law.
b. Opt-out. If you no longer wish to receive text messages from us, reply "STOP," "QUIT," "END," "CANCEL," "UNSUBSCRIBE," or "STOP ALL" to any message from us. You may receive one additional message confirming your opt-out.
c. We will not be liable for any delays or failures in the receipt of any mobile messages, as delivery is subject to effective transmission from your wireless service provider and is outside our control.
d. For support, reply "HELP" to any message or email us at impact@tspfoundation.org. Emailing us is not an acceptable method of opting out; opt-outs must follow the procedure above.
e. Disclosure. Text-messaging opt-in data will not be shared with any third party except: (1) with vendors and service providers who need access to carry out work on our behalf and who will not use the information for their own purposes; or (2) if we believe disclosure is required by applicable law, rule, or regulation, or to comply with legal process.
11. Third-Party Sites
This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating a site to which the Site links. The inclusion of a link on the Site does not imply endorsement of the linked site by us.
12. Donations
We use a third-party service provider (the "Payment Service") to process donations. If you make a donation through the Site, you may be directed to a webpage hosted by the Payment Service rather than by us. Any Personal Information you provide through that page is collected by the Payment Service and is subject to the Payment Service's privacy policy rather than this Privacy Policy. We have no control over, and are not responsible for, the Payment Service's use of information collected through its pages.
13. Use of Site by Minors
The Site is not directed to individuals under the age of thirteen, and we request that these individuals not provide Personal Information through the Site. We do not knowingly collect information from children under the age of 13. To respect the privacy of children and to comply with the Children's Online Privacy Protection Act, children under the age of 13 should not provide any Personal Information on this Site. We ask that parents supervise their children while online.
14. Jurisdictional Issues
The Site is controlled and operated by us from the United States and is intended for individuals located in the United States. We do not represent that the Site is appropriate or available for use outside the United States.
